TERMS OF SALE:

Successful completion of payment for your order will be deemed as acceptance that you have carefully reviewed your order and accept the terms and conditions relevant to the product(s) you have chosen. These include acceptance of expiry dates, conditions of use and validity, credit card transaction fees and postal charges.

By using any product purchased from this site you warrant that you will comply with these Terms and Conditions and all applicable laws and that the products will not be used in any manner which is unlawful, misleading, deceptive or unfair.

If you are purchasing on behalf of, or to give to another person, you agree to ensure that the recipient is aware of all Terms and Conditions and in regard to the use of the products purchased.

NEAT TICKETS PTY LTD reserves the right to amend all or part of these Terms and Conditions at any time.

 

REFUNDS/EXCHANGES/RETURNS:

Once an electronic voucher has been purchased it cannot be refunded. Refunds and exchanges are not available due to a change of mind or if a product is mistakenly selected.

We ask that you carefully review your personal information, selected products, relevant charges, terms and validity conditions prior to proceeding to payment.

Refunds or exchanges are not issued for lost, stolen, damaged or destroyed products, including where a product or eVoucher is delayed in being received either electronically or via Post. Tickets and eVouchers must be treated like cash and kept secure. 

If a product to be mailed is not received, an enquiry must be lodged within 14 days of order at customersupport@neatideas.com.au. To safeguard products ordered via mail, registered post should be selected. Products sent via normal mail cannot be traced and no responsibility can be taken for tickets sent by this method.

A change in personal circumstance or a delay in receiving a product does not entitle a purchaser to return or exchange the product.

Should a purchaser receive a product that differs from their confirmed order, then a refund or exchange will be offered by NEAT TICKETS PTY LTD.

 

VALIDITY:

The validity of products purchased via this website cannot be extended. Products may only be valid for use for a restricted period of time or until a specified date. Products that are not used or redeemed by any such use-by-date will be invalid and no refund or extension of time will be available.

Validity conditions are clearly stated in each product description and will vary from product to product - please read these carefully.

 

AGENT:

In providing products for sale via this website, NEAT TICKETS PTY LTD acts as an agent for various companies who supply those products and related activities. NEAT TICKETS PTY LTD does not accept or undertake any liability when acting in this capacity.

Successful completion of an order on this site will be deemed acceptance of any booking or upgrade fees that may be incurred on redemption of your product and acknowledgment that these fees do not fall under the control of NEAT TICKETS PTY LTD (e.g. extended stay upgrades for ferry travel, online booking fees or 3D/VMAX upgrade fees for cinema bookings).

 

PRICES

While all attempts are made to maintain published prices, prices are subject to change without notice. Prices quoted include GST unless otherwise stated. Completion of an order will be deemed as acceptance that you understand that the discount noted on the website is relevant to the maximum national recommended retail price (“RRP”) of that product. Individual merchants may offer prices which may differ from their listed national RRP at certain times or venues. All orders will incur a 1.5% processing fee.

 

PROHIBITION AGAINST ON-SELLING

You acknowledge and agree that products and services sold on this website are for your personal and non-commercial use, and that you will not on-sell or reproduce any products you have purchased. Failure to comply with this may result in legal action we take against you. You agree that you may not purchase more than two gift cards per transaction.


LIMITATION OF LIABILITY

While Neat Tickets does its best to ensure the optimal performance of the website, you agree that you use the website and rely on material contained in the website at your own risk. To the maximum extent permitted by law, in no event will Neat Tickets be liable for any loss or damage, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this website, any linked site, the downloading of any software or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Neat Tickets is advised of the possibility of such damages, losses or expenses. To the maximum extent permitted by law, liability under any condition or warranty which cannot be legally excluded is limited at Neat Tickets’ option to replacement or resupply of goods or services or payment for the same.

All information, text, material, graphics, software and advertisements on the website (“Content”) are protected by Australian and international copyright and trademark laws. Apart from any use permitted under the Copyright Act 1968 (Cth) you must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute this Content in any way except as expressly provided for on the website or expressly authorised in writing by Neat Tickets. The reproduction, duplication, distribution (including by way of email, facsimile or other electronic means), publication, modification, copying or transmission of material from the website is STRICTLY PROHIBITED unless you have obtained the prior written consent of Neat Tickets or unless it is specifically stated otherwise within the website. TERMINATION

These Terms and Conditions are effective until terminated by Neat Tickets. Neat Tickets may terminate this agreement and your access to the website at any time without notice. In the event of termination, you are no longer authorised to access the website, but all restrictions imposed on you, licenses and waivers granted by you and all disclaimers and limitations of liability set out in these Terms and Conditions (as amended) will survive.

Membership Terms & Conditions

1: Overview

Our Rewards (“Program”) is a membership program which is operated by Neat Corporation PTY LTD ABN 55 166 712 161 (“Neat Corporation”). By enrolling and participating in the Program, you agree that you have read and understood these Terms and Conditions and are bound by them. You consent to Neat Corporation collecting, using and disclosure of your personal information in accordance with the separate Neat Corporation Privacy Policy. You should review this https://www.ourrewards.com.au/privacy-policy-cookie-restriction-mode/ and these Terms & Conditions carefully. If you do not agree to these Terms & Conditions or Privacy Policy, you may not access or otherwise use the website and the services offered on the website or web app.

2: Defined Terms

Activation Date: The commencement date for an Our Rewards membership, triggered by the activation of membership email.

Our Rewards/Program: The membership program which is operated by Neat Corporation and provides Offers to its members.

Member, Members or Membership: A person who holds a current and active Our Rewards membership.

Participating Merchants: A partner merchant that participates in the Our Rewards Program and honours their associated Offers.

Purchase Date: The date of purchase of an Our Rewards Membership Product. Neat Corporation requires approx. 3 business days to activate your membership.

Offer: Those features of the program that provide members with access to discounts on dining, travel, shopping and other categories. Offers may change from time to time without notice.

Other Offers: Other promotions and special Offers which may be offered to you from time to time.

3: Membership

By completing the membership process and using the services, or by viewing or browsing the website, you acknowledge that you have read and understand these Terms & Conditions and Privacy Policy, and that you agree to be bound by them. You have to be a registered member to place orders, access products, access offers/discounts and certain features of Our Rewards website. Members must provide a valid email address and mobile number and create a unique password when joining or activating their Our Rewards Membership, which will be used to log into a Members online account. Members are responsible for maintaining the security of their password and can change it at any time. Neat Corporation takes no responsibility for any loss arising from unauthorised use of a Member’s password or a Member’s failure to comply with these provisions.

Our Rewards Offers can be accessed via Our Rewards website and redeemed at Participating Merchants. Our Rewards Offers are not transferable, not redeemable for cash, are non-refundable, and validity cannot be extended if left unredeemed.

Our Rewards Memberships are valid for 12 months (or 2 years) and must be renewed annually, with payment of the applicable annual fee. At the completion of the membership period, Members will be invited to pay for a new membership period. Members who do not pay their renewal fee by the due date will not be able to access Offers.

Membership can be revoked by Neat Corporation at any time, in its sole discretion and without compensation, for any reason including but not limited to: abuse or breach of any of the Terms and Conditions of the Program, any actions deemed by Neat Corporation to be contrary to Neat Corporation, the Program or the interests of its Members or partners or in the case of fraud or misuse.

Neat Corporation assumes no liability whatsoever, including without limitation, liability for any expense, loss, cost, injury, damage, accident or any other matter or thing whatsoever, however suffered or caused (including compensatory, incidental, indirect, special, punitive, consequential or exemplary damages or damages for loss of income or profits), directly or indirectly arising out of or related to the Program or by reason of the termination of or amendment to the Program in whole or in part, the value or availability of Offers, or the addition or deletion of Offers, Participating Merchants or other features with or without notice.

 

4: Marketing, Promotions and Personal Information

By enrolling in the Program, Members will be automatically enrolled into and consent to,  receiving marketing communications.

It is the responsibility of the member to set their own communication preferences by logging into their account and selecting what they wish to receive and not receive or by selecting to opt-out of receiving email communications by selecting unsubscribe on the email footers. Members are responsible for keeping the information in their account up to date including by not limited to their name, e-mail address, mobile phone number and date of birth.

5: Membership Offers

Offers are only available at Participating Merchants and vary between region. Offers are for personal use only, not business use. Selected offers may be gifted to family members, friends or colleagues and only the offers with “Gift this offer” button on the app can be gifted. Only one redemption per offer is available. Each unique voucher ca only be redeemed once.

Neat Corporation reserves the right to withdraw or amend the products and services it provides on the website without notice. Neat Corporation may restrict access to some parts of, or the entire website from time to time.

 

6: Competitions

Neat Corporation may also from time to time make available to Members promotions and competitions (collectively, “Competitions”). Where applicable, Members may enter Competitions by meeting the entry criteria specified on each Competition. We may publish names of winners of Competition prizes.

Each Competition will be subject to any individual terms and conditions specified on the Website. However, some of the standard terms and conditions are as follows:

  • Awards and prizes must be taken intact as offered and are not transferable, exchangeable or redeemable for cash;
  • If a person otherwise entitled to an award or prize is under the age 18, we reserve the right to instead give the award or prize to that person’s parent or guardian;
  • If an award or prize is unavailable for any reason, we reserve the right to substitute an award or prize of equal or greater value;

Neat Corporation’ decision on all matters relating to a Competition will be final and not subject to challenge or review. Offers may not be redeemed in conjunction with any other promotional offers including, but not limited to, promotional discounted ticket offers. Neither Neat Corporation nor our officers, agents, employees and related bodies corporate make any representation or warranty as to the quality, suitability or merchantability of any goods or services offered or given as awards or prizes.

7: Accessing the Site

Neither Neat Corporation nor its respective officers, agents, employees and related bodies corporate shall be responsible for any failure of the ourrewards.com.au website for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail, online or Internet entry, technical problems, traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to any computer or property related to or resulting from participating in or downloading any material relating to the Program. Neat Corporation reserves the right, at its sole discretion, to cancel or suspend this Program should a virus, bug or any other cause beyond the reasonable control of Neat Corporation corrupt the security or proper administration of the Program.

Any attempt to deliberately damage any website or to undermine the legitimate operation of the Program is a violation of criminal and civil laws and should such an attempt be made, Neat Corporation reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

8: Product Refunds and Membership Transfers

If for any reason you are not satisfied with your Our Rewards Membership, you may within 14 days of purchase contact our office for a full refund. A proof of purchase is required. The refund excludes any delivery or transaction fees paid at the time of purchase. Only the purchaser is entitled to a refund.

Refunds are only permitted for valid memberships that have not been in any way, wholly or partially, used or redeemed. The refunds will be processed back to the purchaser only. After 14 days from the purchase date have passed, no refunds will be granted.

Our Rewards memberships cannot be transferred to third parties at any time without the written approval of Neat Corporation. Neat Corporation has the right to review each individual request for a transfer of membership and may at its sole discretion accept or deny the request for transfer of membership.

9: Legal Guarantees and Warranties

 These Terms and Conditions are governed by and will be construed in accordance with the laws of Australia.

In respect of Our Rewards memberships, independent suppliers provide the products and/or services to you following the redemption of an offer/discount voucher. The independent suppliers accept responsibility for compliance with the Australian Consumer Law in respect of these products and/or services i.e. the product or service was provided with due skill and care and complied with the description provided to the purchaser at the time of purchase. Neat Corporation is not the provider of the product or service; refer to 13 Supplier Offers/Discount, Products or Services

10: Prices

Neat Corporation reserves the right to change prices without notice. All prices quoted on www.ourrewards.com.au are in Australian dollars and are inclusive of GST.

11: Validity

The validity of products purchased via this website cannot be extended. Products may only be valid for use for a restricted period of time or until a specified date. Products that are not used or redeemed by any such use-by-date will be invalid and no refund or extension of time will be available.

Validity conditions are clearly stated in each product description and will vary from product to product - please read these carefully.

Once a voucher has expired, Neat Corporation is under no obligation to offer an extension. Expired vouchers are non-refundable in whole or in part. After a voucher has expired, it is no longer valid and all transaction attempts will be declined.

12: Delivery of Digital Memberships and Gift Vouchers via Email

Neat Corporation is not liable or responsible for any loss suffered as a result of a Membership and/or eVouchers via email being blocked by filters or firewalls, or where the incorrect email address has been entered by the purchaser. Should the member not receive the emailed Membership and/or eVoucher, the member should contact Neat Corporation immediately to have Membership and/or vouchers sent to an alternative email address on customersupport@neatideas.com.au.

13: Supplier Offers/Discount, Products or Services

Neat Corporation cannot guarantee nor will it be responsible for a satisfactory fun family experience or outcome as a result of using information on the website or purchasing products from Our Rewards as such experience or outcome would be subjective to the user.

Neat Corporation is not an operator of any services or products operated by suppliers and has no responsibility for any services or products provided or not provided by the operator or any other party. Neat Corporation does not control the business operations of any product or service operator.

The suppliers provide products and services directly to members. Neat Corporation makes no guarantee or warranty about the product or services that are provided to members by the suppliers. Neat Corporation makes no warranty or representation regarding the standard of any product or service being provided, that it is fit for any purpose or that the product is of merchantable quality.

All Neat Corporation membership offers/discounts are issued subject to the Terms & Conditions of each product and service operator and Our Rewards Terms & Conditions.

Our Rewards suppliers submit and manage their own listings, offers and discounts on Our Rewards website, such listings, offers and discounts can be added and/or removed by suppliers and/or Neat Corporation at any time. Neat Corporation cannot guarantee that a supplier listing, offer and or discounts will be available throughout a member’s 12 month membership period and no refunds will be given for a supplier removing or being removed from Our Rewards Membership program during the member’s membership period.

Neat Corporation cannot be held liable or accountable for inaccurate supplier listing information, offers or discounts submitted by the supplier operator to Our Rewards website and membership program.

14: Limitation of liability

While Neat Corporation does its best to ensure the optimal performance of the website, you agree that you use the website and rely on material contained in the website at your own risk. To the maximum extent permitted by law, in no event will Neat Corporation be liable for any loss or damage, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this website, any linked site, the downloading of any software or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Neat Corporation is advised of the possibility of such damages, losses or expenses. 15: Availability of Product and Services

All offers/discounts for and products and services offered by suppliers are subject to availability. It is recommended that bookings be made via supplier operator website and/or contact details in advance. For peak periods such as weekends and holidays, it is advisable to book early.

Many products and services are weather dependent. The members will have the products and services operator’s details. It is recommended that they contact the supplier operator to enquire whether adverse weather will affect the delivery of the product or service.

All suppliers are subject to removal from Our Rewards website and membership program at any time without notice. Neat Corporation accepts no liability for the removal of an operator or their product or services from the website. In the event that an supplier is removed from the site and the product or service is no longer honouring bookings, members will not be entitled to a refund of their membership with Neat Corporation.

16: Insurance

Neat Corporation promotes offers/discounts to supplier operator products and services which may be considered dangerous. The members should make their own independent enquiries as to the risk involved before redeeming any offers/discounts of any such product or service. The product or service supplier operator warrants that it maintains appropriate public liability insurance for all risks associated with its business and service provision. Neat Corporation makes no warranty or representation about supplier operator’s business, products or services whatsoever. Members are responsible for making their own independent enquiries with regard to the service or product provided by the supplier operator and as to a need to acquire their own insurance cover.

17: Promotional Offers or Promotional Codes

Neat Corporation offers promotional discounts and special offers from time to time. By redeeming any of Neat Corporation promotional codes or promotional offers, the member agrees to accept and comply with all of the following terms and conditions of use:-

Neat Corporation Tickets reserves the right to remove any promotional offer or code without notice at any time.

Promotional offers and codes cannot be used in conjunction with gift vouchers.

If the member has been provided with a valid promotional code, they must enter it into the designated field at the final payment screen where prompted. Otherwise, the discount will not be applied.

Promotional offers and codes must be used before the designated expiration date and cannot be combined.

Unless otherwise specified, promotional codes may only be used once per person. Where multiple promotional codes are offered, only one can be used per transaction. Where multiple discounts apply, the member will receive the maximum discount available.

Neat Corporation reserves the right to verify the validity of a promotional code used at any time. The member is not authorised to disclose the discount /code information to third parties. This information is for members use or access only. If there has been or there is some reason to believe there has been any unauthorised use or disclosure of the discount / code, Neat Corporation will immediately cease all activity on the relevant membership account.

18: Use of Our Rewards

Members agree that Our Rewards products and in particular memberships are explicitly registered to the purchaser of such membership and only this purchaser may access supplier listings and/or redeem offers/discounts available through their membership(s) by suppliers.

Members agree that they may not disclose, share or provide their membership details, supplier listings, offer/discounts to any third parties and should members be found to be sharing or providing membership details, supplier listings, offer/discounts to any third parties, this will result in immediate termination of the member’s access to the website, and/or member membership, and suspension of the member access to products and services.

Our Rewards products and in particular memberships may only be used by the registered members and their immediate family. Immediate family can include spouse/partner and biological or adopted children. To be eligible, all family members must have the same address as the member at the time of purchase.

Our Rewards suppliers may validate a membership prior to redemption of any offered/discounts vouchers by asking the person/s using the Membership to show their driver’s licence or valid ID.

19: Termination

The member agrees that Neat Corporation may, at any time and at its sole discretion, with or without cause or any notice to the member, terminate these terms & conditions, the member’s access to the website, and/or member registration, or suspend or block member access to products and services. Neat Corporation shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by Neat Corporation in connection therewith. If applicable law requires Neat Corporation to provide notice of termination or cancellation, it may give prior or subsequent notice by posting it on the website or by sending a communication to any address (email or otherwise) that it has for the member in Neat Corporation records.

20: Change of Ownership

If, during the membership period, Neat Corporation sells its business and/or database, changes its effective control of the business or ceases to trade, Neat Corporation shall give fourteen (14) days prior written notice of such change to the members. In the case of a sale Neat Corporation will also provide the name, address and contact details of the new owner. In the event of the sale or change of effective control of the business Neat Corporation must obtain a written covenant from the new owner to honour memberships and gift vouchers in accordance with these Terms & Conditions.

21: Disclaimer

This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft, or destruction or unauthorized access or, alteration of or use of record in connection with the use or operation of Our Rewards website, whether for breach of contract, tortious behaviour, negligence or any other cause of action.

Neat Corporation makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Product, Services or the Content contained on the website for any purpose. Any reliance members may place on such information is therefore strictly at their own risk. Neat Corporation disclaims any express or implied warranty representation or guarantee as to the appropriateness of the products or services advertised on the website or that the operation of Our Rewards website will be uninterrupted or error-free. Neat Corporation are not liable for the consequences of any interruptions or error on the website.

22: Terms & Conditions Update

Neat Corporation reserves the right, in its discretion, to correct any errors or omissions in any part of the website, products and services. Neat Corporation may restrict access to parts of or the entire website, and the products and services contained therein at any time, including, but not limited to, content, certain features, products and services, hours of availability, and equipment needed for access or use, without notice or liability.

Any material on the website may be out of date at any given time and Neat Corporation is under no obligation to update such material.

Neat Corporation reserves the right, in its sole discretion, to change, modify, add or remove any part of these Terms & Conditions, in whole or in part, at any time. Notification of the changes to these Terms & Conditions will be posted on the website and will be effective immediately unless expressed otherwise.

It is the member’s sole responsibility to periodically check these Terms & Conditions for any changes. If you do not agree with any of the changes to these Terms & Conditions, it is your sole responsibility to unsubscribe from the website and/or cancel any membership. The member’s continued use of the website will be deemed as their acceptance thereof.

Neat Corporation may assign or sublicense any of its rights or obligations under these terms and conditions at any time, without obtaining the member’s consent.
